November 5, 2007, Perugia, Italy, 10pm.  Raffaele Sollecito received a call from the Perugian police while eating a late dinner with Amanda Knox and two friends.  Both he and Amanda were exhausted from the grief, horror and endless questions by the police since the discovery of Amanda’s murdered roommate, Meredith Kercher, only three days prior.    They were looking forward to some much needed sleep, but instead they were on their way back to the police station in the middle of the night.  They didn’t understand that the 50+ hours they had already spent with the police was to “soften” them up for an all-night interrogation.

For months we have waited for the Italian appellate court in Florence to provide its “motivations” for their startling decision to overturn the unanimous October 2011 innocent verdicts of Amanda Knox and Raffaele Sollecito. The appellate court had the exact same evidence in front of them as did the court which exonerated the two, with the addition of several pieces of evidence that even further bolstered the innocence of Knox and Sollecito. Italy’s bizarre persecution of Amanda Knox, an American citizen, and Raffaele Sollecito, an Italian citizen, ignores the presumption of innocence required by at least two international human rights treaties. The International Covenant for Civil and Political Rights (ICCPR), a treaty monitored by the United Nations, specifically requires that a presumption of innocence be afforded all defendants in a criminal trial (Art. 14, Section 2). The European Convention for Human Rights (ECHR) contains a similar requirement (Art. 6, Section 2). Italy is a member of the ECHR, and if the country’s supreme court, the Court of Cassation, fails to set this right on final appeal, the European Court for Human Rights may have to step in. Days before the horrible shots rang out, thousands of Chinese who sought nothing more than freedom converged on Tiananmen Square in Beijing to demonstrate for, among other things, the freedom to speak. They knew what they risked that warm June in 1989; it wasn’t police who showed up to disperse the group, it was soldiers and tanks. But the demonstrators did not disperse. In the end, hundreds or even thousands of these brave souls were shot and machine-gunned into silence. One man, however, galvanized the world with his selfless resistance. The Italian Supreme Court is set to rule once again on the case against Amanda Knox and Raffaele Sollecito. The two currently stand convicted of the 2007 murder of Meredith Kercher in a hilltop cottage in Perugia, Italy. The case, fraught with controversy, has seen Knox and Sollecito convicted, exonerated, and then convicted again. All while a third defendant, Rudy Guede, has been tried and convicted in a separate “fast track” trial that resulted in a 16-year sentence when finalized by the high court. Continue reading →

here could be a final ruling as soon as Wednesday in the long, drawn out murder case of Amanda Knox. Knox and her former Italian boyfriend, Raffaele Sollecito, are asking Italy's highest court to throw out their convictions for the murder of British student Meredith Kercher in Perugia, Italy in 2007.

The case has been full of twists and turns. The pair were convicted in 2009 and sent to prison, then released on appeal in 2011. But Italy's highest court, the Court of Cassation, threw out their acquittals in March of 2013 and sent the case to a Florence appeals court. In January 2014, that court re-convicted them both, sentencing Knox to 28 ½ years in prison and Sollecito to 25 years. They appealed and the case went back to the Court of Cassation, which is holding the hearing in Rome Wednesday. Continue reading →
